Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, products, and services provided by Bridgeline Digital, Inc. (“Bridgeline Data”, “we”, “us”, “our”). Bridgeline Data is a software and data publishing company (SIC 7372 — Services-Prepackaged Software) that publishes structured data feeds and research datasets compiled from public-record source systems. By accessing or using the Services, you agree to be bound by these Terms.
1. Eligibility & Accounts
You must have authority to accept these Terms on behalf of yourself or your organization. Institutional accounts are intended for professional subscribers. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
2. Access & Subscriptions
Access to data feed products and the publication dashboard is granted through an institutional access request and may be subject to a subscription plan. Where a paid subscription applies, it renews automatically at the end of each term until cancelled. You may cancel at any time, and your access will continue until the end of the then-current billing period. Fees are exclusive of taxes. We may adjust pricing or packaging upon reasonable notice. If you have been granted complimentary or evaluation access, the terms of that grant control the scope and duration of your access.
3. Acceptable Use
- No unlawful, infringing, or harmful activities.
- No reverse engineering, unauthorized access, or interference with the Services.
- No redistribution of subscription content outside your licensed seat.
- Comply with carrier and CTIA guidelines for all SMS communications.
4. Customer Data & Privacy
You retain ownership of Customer Data. You grant Bridgeline Data a license to process Customer Data to provide and improve the Services. Our use of personal data is described in our Privacy Policy.
5. Intellectual Property
We and our licensors retain all rights, title, and interest in and to the Services, including data compilations, software, documentation, designs, and trademarks. You may not use our marks without prior written consent.
6. SMS Program (Data Feed Publication & Research Dataset Release Alerts)
By opting in to SMS, you consent to receive recurring transactional SMS messages from Bridgeline Digital, Inc. (operating as “Bridgeline Data”) regarding event-driven data feed notifications across our six publishing verticals:
- Litigation Alerts: notifications when tracked court docket and enforcement data feeds publish new or updated releases.
- Markets Alerts: notifications when SEC filing streams and financial data feeds publish new or updated releases.
- Legislative Alerts: notifications when Federal Register and agency data feeds publish new or updated releases.
- Labor Alerts: notifications when state labor department WARN layoff and closure notice feeds publish new or updated releases.
- Economic Alerts: notifications when economic indicator datasets publish new statistical releases.
- Energy Alerts: notifications when geophysical event streams and environmental data feeds publish new or updated releases.
You may opt in to SMS alerts at the dedicated opt-in page at https://bridgelinedata.com/sms/opt-in. Opt-in requires separate Terms agreement and SMS consent checkboxes (unchecked by default). SMS consent is optional and is not a condition of purchase.
Message frequency varies based on data feed publication cadence and dataset release schedules. Message & data rates may apply. Reply STOP to cancel; HELP for help. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase.
7. Opt-Out of SMS
You may opt out of SMS alerts at any time by replying STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any SMS message you receive. Upon receipt of your opt-out request, we will process it immediately, cease sending SMS messages, and send a confirmation message. You may resubscribe by replying START.
8. Warranties & Disdataers
THE SERVICES AND DATA CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” FOR INFORMATIONAL PURPOSES ONLY, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. Published data feeds and research datasets are compilations of public-record source material and do not constitute legal, medical, financial, or investment advice.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Bridgeline Digital, Inc. AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY DATA SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
10. Governing Law
These Terms are governed by the laws of Delaware, United States, without regard to conflicts of law principles. The courts of Delaware shall have exclusive jurisdiction.
